FEDERAL PUBLIC NOTICE

The Norfolk District announces the issuance of the 2023 State Programmatic General Permit for piers, aquaculture, shoreline, dredging, and other activities (23-SPGP-PASDO). Effective September 5, 2023, the 23-SPGP-PASDO permit replaces and supersedes Regional Permits (RP) 02, 17, 18, and 19.

For activities that have been authorized under the above expiring permits and have commenced (i.e., under  construction) or are under contract to commence in reliance upon these RPs, will remain authorized provided the activity is completed within twelve (12) months of the date of the RP's expiration. Activities completed under the authorization of these RPs which was in effect at the time the activity was completed continue to be authorized by those RPs.

23-SPGP-PASDO authorizes, by the Secretary of the Army and the Chief of Engineers, under Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. § 403) and under Section 404 of the Clean Water Act (CWA) (33 U.S.C. § 1344), certain pier, aquaculture, shoreline, dredging, and other activities in tidal or non-tidal waters of the United States (WOTUS), including wetlands, within the geographical limits of the Commonwealth of Virginia and under the regulatory jurisdiction of the U.S. Army Corps of Engineers, Norfolk District (Corps or Norfolk District). These projects must not cause the loss of greater than 1/2 acre of WOTUS, must have no more than minimal individual and cumulative impacts to WOTUS, and must have avoided impacts to WOTUS to the greatest extent practicable.

The Norfolk District issued this permit with an expiration date of September 4, 2028. The 23-SPGP-PASDO and associated documents can be found on our web site at: https://www.nao.usace.army.mil/Missions/Regulatory/RBregional.aspx.

As of the date of this public notice, the Norfolk District Corps of Engineers received unconditional certification regarding water quality (WQC) under Section 401 of the Clean Water Act, and a conditional consistency determination under the Coastal Zone Management Act (CZMA) for the 23-SPGP-PASDO.
