    The bank sponsor proposes to establish, design, construct and operate a compensatory stream mitigation bank to be known as the Lower James Stream Mitigation Bank. The purpose of the mitigation bank is to provide off-site compensatory mitigation for projects that result in unavoidable impacts to non-tidal streams in the James River Watershed. Public comment period ends April 29, 2013.

    This is a reissuance of the original public notice dated September 7, 2012 to show recently submitted changes to the project. These changes include additional impacts to open water pond areas on the property. The applicant proposes to construct a mixed use development to include multi-family and single family housing developments along with roads and utility servitudes.     The applicant proposes to construct an earthen berm along the southern property boundary of the property known as Curles Neck Farm in order to protect the wetland system from sea level rise. The applicant proposes to convert an onsite borrow pit into a mitigation area and create 3.1 acres of tidal forested wetlands and 0.5 acres of emergent tidal wetlands.     The applicant, Elizabeth River Crossings, OpCo, LLC is proposing modifications to the Midtown Tunnel construction permit which was originally issued in November 2012 for work in the Elizabeth River in the cities of Norfolk and Portsmouth. These modifications include deeper dredge cuts to remove unsuitable materials, revisions to the location and design of three temporary piers, and the use of timber pilings to support turbidity curtains. Public comment period ends Jan. 31, 2013.

    Capital One Services, LLC proposes to discharge fill material in forested wetlands to construct an approximately 150,000 square feet one-story building to be used for data center expansion, customer service center, and/or administrative office in Chesterfield County, Va. The project also includes the construction of approximately 900 parking spaces. Public comment period ends Nov. 30, 2012.
