FEDERAL PUBLIC NOTICE
The Norfolk District announces the reissuance of Regional Permit 22 that expired September 5, 2023. Effective December 21, 2023, this permit supersedes and replaces all previous versions.

Regional Permit 22 (23-RP-22) authorizes, by the Secretary of the Army and the Chief of Engineers, under Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C § 403) and under Section 404 of the Clean Water Act (CWA) (33 U.S.C. § 1344), certain piers, boat docks, boat ramps, and boathouses; excavation of boat slips and channels; construction and backfilling of bulkheads and placement of rip rap; and installation of submerged, aerial power lines and utility lines and living shorelines in non-tidal waters of the United States (WOTUS), including wetlands within the Virginia portions of Lake Gaston in Mecklenburg and Brunswick Counties. These projects must have no more than minimal individual and cumulative impacts to WOTUS, and must avoid impacts to WOTUS to the greatest extent practicable.

The Norfolk District issued this permit with an expiration date of December 21, 2028. The newly issued Regional Permit can be found on our website at: https://www.nao.usace.army.mil/Missions/Regulatory/RBregional.aspx

As of the date of this public notice, the Norfolk District has received a conditional water quality certification (WQC) under section 401 of the Clean Water Act and a consistency determination under the Coastal Zone Management Act (CZMA) is not required.
