  • NAO-2015-00849 / 15-V1607 15-day Public Notice (Hickory Woods Subdivision, Chesapeake, VA)

    The permittee requests modification of the permit for a time extension from the date of expiration (September 21, 2023). The proposed activities include permanently impacting 0.20 acre of palustrine forested (PFO) wetlands, 1.9 acres of palustrine emergent (PEM) wetlands, and 0.08 acre of palustrine open water (POW) for the purpose of constructing a mixed used residential development with commercial amenities known as Hickory Woods. Public comment should be received by the close of business on January 23, 2024.

  • NAO-2005-04213 (SMM Southeast LLC Bulkhead/Dredging Project, Chesapeake, VA)

    Expiration date: 12/24/2023

    The applicant proposes to stabilize the existing failing bulkhead surrounding the existing man-made slipway. This project includes two activities: (1) fill the existing slipway with dredged material obtained from the waterfront adjacent to the slipway, and (2) install 230 linear feet of new vinyl bulkhead seaward of the existing failing bulkhead and slipway. The project will improve the functionality of the site to facilitate on-going operations through the construction of the new bulkhead and filling of the existing man-made slipway. The proposed activities will result in unavoidable, permanent impacts to 2,613 square feet (0.06 acre) of tidal vegetated wetlands, 75,155 square feet (1.73 acre) of subaqueous bottom for fill, and 76,517 square feet (1.76 acre) of subaqueous bottom for dredging. The applicant is requesting a 10-year permit that will allow for periodic maintenance dredging in order to maintain a maximum dredge depth of -12 feet (MLW) to meet the needs for facility operations. Comments should be received by the close of business on December 26, 2023.

    Interested parties are hereby notified that a request for permission to alter a U.S. Army Corps of Engineers (USACE) project pursuant to Section 14 of the Rivers and Harbors Act of 1899 (33U.S.C. Section 408) has been received and will be evaluated by the Norfolk District. Written comments, including any objections to the proposed alteration, stating reasons therefore, are being solicited from anyone having an interest in the requested alteration. The authority to grant permission for temporary or permanent use, occupation or alteration of any USACE Civil Works project is contained in Section 14 of the Rivers and Harbors Act of 1899, as amended, codified at 33 USC 408 (“Section 408”). Section 408 authorizes the Secretary of the Army to grant permission for the alteration or occupation or use of a USACE project if the Secretary determines that the activity will not be injurious to the public interest and will not impair the usefulness of the project. The proposed action is also subject to the requirements and objectives of Executive Order (EO)11988, Floodplain Management and has the potential to impact floodplains. This notice complies with Section 2(a)(4) of EO 11988 and requests advance public comment to determine if there are any public concerns regarding potential impacts on floodplains.

The District Commander has received a modification to the joint permit application for Federal and State permits.
