Permit Application No.
NAO-2013-02047-TREC (25-V0058)

TO WHOM IT MAY CONCERN: The Norfolk District of the U.S. Army Corps of Engineers (Corps) has received an application for a Department of the Army permit pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344). The purpose of this public notice is to solicit comments from the public regarding the work described below:

APPLICANT:
Crescent Development
Attn: Scott Williams
PO Box 5586
Charlottesville, Virginia 22905

AGENT:
Balzer and Associates, Inc.
Attn: Sandy Tice
15871 City View Drive, Suite 200
Midlothian, Virginia 23113

WATERWAY AND LOCATION:  The project would affect waters of the United States (WOTUS) associated with tributaries to Goose Creek.  The project/review area is located on the northwest of the Lifecore Drive and Old Goose Creek Road intersection and south of Jefferson Highway; at Latitude 38.10556 and Longitude -78.996944; in Augusta County, Virginia.

PROPOSED WORK and PURPOSE:  The applicant requests authorization to construction Phase 5 and 6 of the residential development known as Myers Corner. Impacts to WOTUS are associated with the construction of a stormwater management basin and a sanitary sewer connection. Permanent impacts proposed include 0.49 acre of palustrine emergent wetland, 0.65 acre of palustrine open water, and .003 acre (130 linear feet) of ephemeral stream channel. Temporary impacts include 0.001 acre of ephemeral stream channel (28 linear feet).

AVOIDANCE AND MINIMIZATION: The applicant has provided the following information in support of efforts to avoid and/or minimize impacts to the aquatic environment:
The applicant has limited utility impacts to one crossing that will be located within the right-of-way easement along the existing thoroughfare known as  Old Goose Creek Road.  Impacts associated with the utility crossing are temporary and will be restored to pre-construction contours once installation is complete.

The applicant is prosing to place the stormwater basin within an area of the parcel where runoff and drainage is naturally drive due to the topography of the site.  The applicant has designed the stormwater in a manner that ensures hydrology will remain throughout the system both upstream and downstream of the proposed stormwater basin. The applicant is proposing to avoid the  majority of the southwestern wetland system by limiting impacts to 0.01 acre of impacts associated with the outfall installation.

The applicant has evaluated additional avoidance and minimization measures that include removing road crossings outside of the wetlands and converting the existing open water feature to stormwater open waters in order to avoid the southwestern wetland system. The Corps continues working with the applicant to evaluate the avoidance and minimization measures as well as alternatives analysis.

A copy of the joint permit application can be found on the Virginia Marine Resources Commission’s website: https://webapps.mrc.virginia.gov/public/habitat/getPDF.php?id=20250058

COMPENSATORY MITIGATION: The applicant offered the following compensatory mitigation plan to offset unavoidable functional loss to the aquatic environment: purchasing 0.49 wetland credits at a 1:1 ratio for the loss of palustrine emergent wetlands and the purchase of 25 stream credits for the permanent loss of 0.003 acre (130 linear feet) of stream channel.  All credits will be purchase from a Corps approved wetland and/or stream mitigation bank.
