    Virginia Electric and Power Company proposed to construct a and operate a new fossil fuel combustion products management facility that would facilitate the mandated closure of the coal combustion residual (CCR) surface impoundment at the Bremo Bluff Power Station located in Fluvanna County, Virginia. The impact area is located at approximately 37.438669 (latitude), -79.919651(longitude) and consists of 244 square feet of permanent stream impact across 105 linear feet of stream. The Permittee Responsible Mitigation site includes construction of 5.72 acres of forested wetlands from existing fields including impacts to 0.15 acres of palustrine emergent wetlands that will be converted into 0.15 acres of palustrine forested wetlands for the purpose of providing compensatory mitigation for Rountrey Subdivision Section 9. Public comments should be received by the close of business on April 4, 2022.

The project is located adjacent to the existing Northern Virginia Stream Restoration Mitigation Bank (Bank), along the Wolf Run stream reach, along unnamed tributaries to the Occoquan and in Fairfax County, Virginia. The Sponsor proposes to modify the existing Bank by adding the Fountainhead preservation area which includes 19,720 linear feet of stream channel and 193.2 acres of riparian buffer.

    On December 27, 2021, the U.S. Army Corps of Engineers published a final rule in the Federal Register (86 FR 73522) announcing the reissuance of 40 existing nationwide permits (NWPs) and one new NWP. These 41 NWPs will go into effect on February 25, 2022, and they will expire on March 14, 2026. This Public Notice also announces Norfolk District’s Final Regional Conditions, the Section 401 Water Quality Certification (WQC) and the Coastal Zone Management Act (CZMA) determination for the 41 nationwide permits (NWPs). The proposed Bank is located on approximately 298 acres of abandoned golf course, forest, and agricultural land and is located along Old Plantation Creek a tributary to the Chesapeake Bay in Northampton, Virginia. The purpose of the Bank is to provide off-site compensatory mitigation for projects that result in unavoidable impacts to wetlands and other waters of the United States in the Lower Chesapeake Bay Drainage Basin.

    Last week, Office of the Assistant Secretary of the Army for Civil Works announced the work plans for two recently enacted laws — the Infrastructure Investment and Jobs Act; and the 2022 Disaster Relief Supplemental Appropriations Act– which will provide the Norfolk District, U.S. Army Corps of Engineers with an additional $328 million for fiscal year 2022.
