    PROJECT DESCRIPTION AND PURPOSE:  Construct a freshwater impoundment for the retention and delivery of sufficient quality and quantity of water to the adjacent coal preparation plant to facilitate continued coal extraction/recovery of metallurgical bituminous coal from the existing underground Buchanan No. 1 mine for an anticipated 25-years.  The proposed impoundment is planned to provide for 96-acre-feet of storage and the applicant anticipates that it would provide 2,400 gallons per minute, or approximately 3.5 million gallons per day of freshwater, for processing raw material for a targeted annual output of 1-2 million tons of cleaned coal.  Construction of the impoundment would permanently impact approximately 1,340 linear feet of Garden Creek.  Specifically,  the construction of the dam would result in a permanent loss of 480 linear feet of streambed and the subsequent backfilling of Garden Creek would result in a permanent conversion of 860 linear feet of stream habitat to open water habitat.

    WATERWAY AND LOCATION OF THE PROPOSED WORK:  The project is located in the Levisa Fork River and tributary streams, near Grundy, Virginia. PROPOSED WORK AND PURPOSE:  The applicant proposes to construct 1.78 miles of new roadway, dually designated U.S. Highway 121/460-Poplar Creek Phase B.  The road will consist of 2 lanes with truck climbing lanes where necessary.  The project is proposed to extend from the east end of the dually designated U.S. 121/460 Poplar Creek Phase A Section, near State Route 604 (Poplar Creek Road), that is currently under construction to U.S. Route 460 near Grundy, VA.  Due to the mountainous terrain, road construction will require removal of a large amount of material to establish a suitable road alignment in the terrain.  Some of this material will be utilized as road fill but a large amount of excess fill material will require disposal.  This excess material will be disposed of in a valley resulting in stream impacts and utilize an existing disposal site permitted as part of the Phase A construction.

    The Black Diamond Company proposes to fill approximately 430 linear feet of stream bed in support of expanding the currently operating Stateline Branch Refuse Facility. Specifically, this site would allow permanent placement of approximately 7,100,855 cubic yards of coarse refuse from the applicant’s coal preparation plant extending the life of the operation over the next 8 to 9 years. The project is located in an unnamed tributary of Stateline Branch, a tributary to the Upper Levisa, Big Sandy River, at Big Rock, Buchanan County, Virginia..

    The applicant proposes to construct Section IIIB-Phase A of US Highway 121, which overlaps Corridor Q, and will be dual designated as US 460/121. The project involves construction of 2.8 miles of two-lane rural principal arterial highway on new alignment, with truck climbing lanes at some locations, and will cross Poplar Creek with a box culvert over which will be placed excavated material from elsewhere on the project. Proposed permanent impacts are 0.22 acres wetlands, 0.23 acres open water, 3,530 linear feet perennial streams, and 1,160 linear feet intermittent streams.
