Interested parties are hereby notified that a request has been received for permission to alter a U.S. Army Corps of Engineers (USACE) federal civil works project, operated and/or managed by the Norfolk District, pursuant to Section 14 of the Rivers and Harbors Act of 1899 (33 U.S.C. Section 408). Under Section 408, the Secretary of the Army has authority to grant permission for temporary or permanent use, occupation or alteration of any USACE civil works project, as long as it is determined that the activity will not be injurious to the public interest and will not impair the usefulness of the project. Written comments, including any objection to the proposed alteration, stating reasons therefor, are being solicited from anyone having an interest in the requested alteration.
A 408 Review request (NAO-2025-0074) has been received from the City of Virginia Beach Public Schools for the proposed public boardwalk across a restored marsh project along Thalia Creek.
The action considered as part of this 408 review is located at Princess Anne High School (PAHS) in Virginia Beach, Virginia, and has the potential to impact the Lynnhaven River Basin Ecosystem Restoration Project – Phase 1 Wetland. The action is proposed at the restored wetland site and includes the addition of a public boardwalk to serve as a “scientific transect” across the marsh for high school students. The 1,001 square foot boardwalk will have step-down transitions to platforms for students to be at marsh-level to measure vegetation and wildlife samples. The walkway will comply with the Americans with Disabilities Act (ADA) and create an additional outdoor education space and a safe access way into the marsh for students and faculty. The proposed action will have a negligible effect on the restored wetland site. Written comments may be submitted via mail to:
