  • NAO-2025-02379 / 25-V1589 (City of Virginia Beach - Windsor Woods Pump Station and Thalia Creek and Lake Trashmore Improvements project)

    The applicant is requesting a DA permit for the construction of a tide gate across Thalia Creek at its confluence with Lake Windsor along with an interim pump station (Windsor Woods Tide Gate: DEQ Permit 18-1977, issued March 20, 2020; USACE Permit NAO-2018-01381/VMRC# 18- V1977 issued April 13, 2020). The tide gate was constructed to reduce the water levels in Lake Windsor during storm events to increase its storage capacity for stormwater runoff. The interim pumping station, which will be replaced with the new permanent stormwater pump station, that is part of the proposed project, will further reduce Lake Windsor’s water levels, and pump water during storm events into downstream waters of Thalia Creek. Additionally, the project involves maintenance dredging within the portion of Thalia Creek between Lake Windsor and Lake Trashmore to improve conveyance within the Creek. Once the dredging activities are complete, two new culverts interconnecting Lake Trashmore and Thalia Creek will be constructed. Weir gates will be installed at Lake Trashmore openings of the culverts. As proposed, the project would result in temporary and permanent impacts to 3.25 acres of wetlands and waters within Lake Windsor, Thalia Creek, and Lake Trashmore. The proposed permanent impacts consist of 0.09 acre of Estuarine Scrub Shrub (ESS) wetlands, 2.46 acres of Estuarine Open Water (EOW), and 0.15 acre of Palustrine Open Water (POW). The proposed temporary impacts consist of 0.54 acre of EOW. The proposed project’s purpose is to reduce flooding within the Windsor Woods neighborhood, which has experienced significant flooding and property damage. The project is needed to protect the residents and their homes and belongings from flooding and to allow for safe evacuation during flood events. The pump station will operate based on the levels of Lake Windsor, drawing down water levels during pre-storm operation to a target elevation of -1 feet NAVD88 and will continue to operate during the storm to maintain storage levels. The improvements to Thalia Creek will improve the flow between Lake Windsor and Lake Trashmore to provide more uniform storage capacity with the goal of reducing flooding in the Windsor Woods neighborhood.

    The Nature Conservancy is proposing an 81-acre acre mitigation site near the Town of Dickenson’s Corner. Proposed activities include stream restoration and enhancement and stream buffer restoration and preservation. The Sponsor proposes to generate a total of 7,398 stream credits to include 2,134 stream restoration and enhancement credits, as well as 4,799 stream buffer restoration and 113 stream buffer preservation credits for the purpose of providing off-site compensatory mitigation for unavoidable impacts to waters of the U.S. associated with DA permits within the proposed Geographic Service Area (GSA).
  • NAO-2009-00044 (Coastal Virginia Conservancy Instrument)

    The Coastal Virginia Conservancy (CVC) proposes two modifications of their approved In-Lieu Fee (ILF) Instrument. First, they propose to increase the program administrative fees from 15% to 20% of all credit sales. The requested increase would be used to fund additional staff for the Coastal Virginia Conservancy and help offset the increasing administrative costs associated with managing the program. Second, they propose to expand the instrument ledger to include two subledgers for fund management. Specifically, the two subledgers would include a development and a reserve account.
  • NAO-2021-02695 (QTS RIC 5, Henrico, Virginia)

    Expiration date: 7/9/2026

    QTS Richmond V, LLC requests authorization to expand the existing QTS RIC5 data center campus within the White Oak Technology Park in Sandston, Virginia, by constructing Data Center Building 5 (DC-5), which will include the construction of DC-5 and its associated infrastructure including utilities, technologies, parking facilities and stormwater management facilities. The project will result in impacts to approximately 4.29-acres of palustrine forested wetlands. The applicant proposes to construct a PRM site, known as the QTS RIC 5 PRM Site, that will be located on a 10.9-acre site and result in 8.32 wetland credits to offset unavoidable impacts.

  • NAO-2024-02657 (City of Virginia Beach The Lakes and Princess Anne Plaza Drainage Improvements project, Virginia Beach, Virginia)

    Expiration date: 5/20/2026

    The applicant requests authorization for the construction of the NLBC and SLBC tide gates, the SLBC weir gates, and the wing wall area proposed along the tide gates and weir gates to protect soils, facilities, and to direct water flow, as well as grading and filling for the construction of the pump station, construction of internal maintenance and access roads, stormwater (SWM) and utilities. The proposed activities will result in permanent impacts to wetlands and waters of the U.S. across NLBC and SLBC including 8,015 square feet (0.18 acre) of palustrine forested (PFO) wetland impacts; 68,112 square feet (1.56 acres) of palustrine open water (POW) impacts; 18,807 square feet (0.43 acre) of tidal non-vegetated wetlands (TNVW) impacts; 16,408 square feet (0.38 acre) of estuarine scrub-shrub (ESS) impacts; 5,211 square feet (0.12 acre) of estuarine emergent (EEM) impacts; and 49,545 square feet (1.14 acres) to estuarine open water (EOW) impacts. Additionally, the project will include the dredging of London Bridge Creek and the eastern drainage channel at NLBC as well as dredging of The Lakes Channel and Green Run Canal at SLBC, resulting in permanent, unavoidable impacts to 38,099 square feet (0.87 acre) of open water (EOW). The construction of and activities related to the construction of the NLBC and SLBC tide gates and weir gates as well as the proposed dredging activities will also result in the permanent conversion of wetlands into other habitat types. Cumulatively, there is proposed permanent conversion of 3,260 square feet (0.07 acre) of PFO wetland to PEM, PUB, and Estuarine Unconsolidated Bottom (EUS); 13,337 square feet (0.31 ac) of TNVW to EUS and EOW; 6,344 square feet (0.15 ac) of ESS to EUS and EOW; 4,617 square feet (0.11 ac) of EEM to PUB, EUS, and EOW. The project will also include the construction access to the retaining wall and associated grading and installation of a temporary trestle at NLBC, resulting in temporary impacts to 968 square feet (0.02 acre) of PFO, 5,355 square feet (0.12 acre) of TNVW, 2,119 square feet (0.05 acre) of ESS, 1,478 square feet (0.03 acre) EEM, and 2,398 square feet (0.06 acre) EOW. All temporary impacts will be returned to preconstruction contours and seeded/planted with appropriate wetland vegetation as applicable. The proposed project’s purpose is to address flooding in The Lakes and Princess Anne Plaza neighborhoods, which have experienced repeated flooding from both major and minor storm events due to low-lying topography, outdated stormwater infrastructure, tidal influence, and limited runoff storage. In order to maximize flood mitigation in these neighborhoods, one tide gate would not be sufficient as London Bridge Creek receives hydrologic input from both the Lynnhaven River to the north and West Neck Creek/ Canal 2 from the south depending upon tides and wind events. The tide gates at both sites (NLBC and SLBC) work together to form an integrated system to manage stormwater and protect neighborhoods from both tidal and rainfall-induced flooding, regardless of whether the tidal flooding comes from the south or north. The tide gates will remain open to allow the passage of water through the system and the forebay gates will be closed other than for routine maintenance.
