    The purpose of this Public Notice is to provide an update on the status of the Nationwide Permits and Regional Conditions used by the Norfolk District. The Norfolk District received the Federal Consistency Determination submitted under the Coastal Zone Management Act (CZMA) for the reissuance and modification of the Nationwide Permits and the Virginia Regional Conditions on April 5, 2017 and we received Section 401 Water Quality Certification from the Commonwealth of Virginia on April 7, 2017. In addition, we made some minor editorial changes to the Regional Conditions for the 2017 Nationwide Permits.
  • Issuance of the 2017 State Programmatic General Permit (17-SPGP)

    Expiration date: 5/11/2017

    The Norfolk District proposes the issuance of the 2017 State Programmatic General Permit (17-SPGP). The 17-SPGP is proposed for use with residential, commercial, institutional and linear transportation projects that meet the requirements and general conditions as written in the proposed 17-SPGP permit authorization. The 17-SPGP will be a modified version of and replace for the 12-SPGP-01 which is set to expire May 31, 2017.

    The project is located in unnamed tributaries of the Chickahominy River, tributary to the James River and Chesapeake Bay, at the northwest quadrant of the intersection of Atlee Station Road and Giles Farm Road, Hanover County, Virginia.The applicant proposes to construct a mixed development consisting of townhomes, cluster homes and a small number of larger acreage lots, roads, stormwater facilities and utilities, on a 58.7 acres known as Giles Farm Phase I.

    The project is located on unnamed tributaries of the Chickahominy River, tributary to the James River and the Chesapeake Bay, at the northwest quadrant of the intersection of Atlee Station Road and Giles Farm Road, Hanover County, Virginia.The applicant proposes to construct 265 single family home lots, a community center, roads, storm water facilities, and utilities on 201 acres parcel known as Giles Farm subdivision phase II. The applicant stated purpose is to provide house for a demand in the area along Atlee Station Road. This development will tie into Giles Farm Subdivision phase I

    Effective immediately, and until further notice, the attached Regional Conditions are applicable within the Commonwealth of Virginia for the 2017 Nationwide Permits (NWPs), which were printed in the Federal Register on January 6, 2017, and became effective on March 19, 2017. The Regional Conditions specify additional restrictions and requirements that have been placed on the applicable Nationwide Permits to ensure that impacts within the Commonwealth of Virginia will not be more than minimal.
