  • Clean Water Act: proposed rule for definition of waters of the U.S.

    Expiration date: 7/21/2014

    On April 21, 2014, the Environmental Protection Agency and the Corps of Engineers published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act, in light of the U.S. Supreme Court cases. Developing a final rule requires public involvement. Public comment period ends July 21, 2014.

    Clintwood Elkhorn Mining Company proposes to conduct bituminous coal extraction on a proposed surface mine of approximately 260 acres in Buchanan County, Va. The applicant proposes to fill and excavate waters of the U. S. during mining and excess material disposal for the purpose of recovering approximately 2.2 million tons of coal. Public comment period ends Jan. 11, 2013.
