    The Coastal Virginia Conservancy (CVC) proposes two modifications of their approved In-Lieu Fee (ILF) Instrument. First, they propose to increase the program administrative fees from 15% to 20% of all credit sales. The requested increase would be used to fund additional staff for the Coastal Virginia Conservancy and help offset the increasing administrative costs associated with managing the program. Second, they propose to expand the instrument ledger to include two subledgers for fund management. Specifically, the two subledgers would include a development and a reserve account.

    The Coastal Virginia Conservancy is proposing the establishment of the Paradise Creek 2 Site to offset impacts to tidal wetlands/waters authorized as part of future federal and state permits. The proposed compensatory mitigation site is located with Paradise Creek in Portsmouth, Virginia.

    The Nature Conservancy is proposing the establishment of a mitigation site known as UJ-5 Potts Creek (Adrian LLC) to offset non-tidal wetlands and stream impacts authorized as part of future federal and state permits. The proposed compensatory mitigation site is located at on Potts Creek Road near Covington, Virginia in Alleghany County.

    The Nature Conservancy is proposing the establishment of a mitigation site known as SH-9 Laurel Fork (Goodall) to offset non-tidal wetlands and stream impacts authorized as part of future federal and state permits. The proposed compensatory mitigation site is located at 936 Collins Run Lane, Monterey which is located in Highland County, Virginia.
  • NAO-2009-00044 (LRRT Paradise Creek Projects 2 and 3, Portsmouth, Virginia)

    Expiration date: 6/15/2024

    The Sponsor, Coastal Virginia Conservancy (Living River Restoration Trust) proposes to design, construct, and manage 2 additional compensatory mitigation sites in Paradise Creek. The Sponsor proposes to place a thin layer of granular activated carbon on the existing surficial sediment in 6 areas of Paradise Creek, using a mechanical delivery system. In addition, the Sponsor proposes to develop the final sediment remediation techniques to be applied to 8 areas of Paradise Creek as the Projects move forward. The proposed activities are anticipated to generate approximately 12 compensatory mitigation credits. Comments should be received by the close of business on June 15, 2024.
