FEDERAL PUBLIC NOTICE
The District Commander received a joint application for Federal and State permits as described below:

WATERWAY AND LOCATION OF THE PROPOSED WORK: The project is located in the Simpsons Creek watershed, north of Leesburg Pike (Route 7), south of West Loudoun Street, and west of Mystic Lane in Loudoun County, Virginia. A vicinity map is attached.

PROPOSED PROJECT: The applicant is proposing to construct a six-lot residential subdivision and associated infrastructure within two parcels of land totaling approximately 7.3 acres. The work will result in permanent impacts to 3,248 square feet (0.07 acres) of nontidal emergent wetlands.
PROJECT PURPOSE AND NEED: Construction of single-family residences in the Round Hill region of Loudoun County including the infrastructure (driveway, utilities, stormwater management) necessary to serve the proposed usage.
AUTHORITY: Permits for the work in waters, including wetlands, are required pursuant to Sections 401 and 404 of the Clean Water Act (Public Law 95-217). The Corps must comply with the National Historic Preservation Act (NHPA) (54 U.S.C. § 306108), 36 CFR Part 800, regulations implementing Section 106 of the NHPA and 33 CFR Part 325, Appendix C, Processing of Department of the Army Permits.
PURPOSE OF PUBLIC NOTICE: In compliance with regulations implementing Section 106 of the NHPA, the Corps is soliciting comments on the proposed project from the public; federal, state, and local agencies and officials; Native American Tribes; and other interested parties. This public notice provides an opportunity for members of the public to express their views on the undertaking’s effects on historic properties and resolution of adverse effects. The Corps is requesting comments to assist in evaluation of the effects of the project on historic properties and evaluation of alternatives or modifications which could avoid, minimize, or mitigate adverse effects on historic properties.
Historic Property Identification: The Corps identified historic properties within the Corps permit area. An architectural resource survey was conducted on the project site and a report entitled “Phase I Reconnaissance-Level Architectural Survey for the Skyhill Court Subdivision Project, Loudoun County, VA and Phase II Intensive-Level Survey Of Yatton (053-1071) Loudoun County, VA” was prepared by Zeller Preservation Group. The survey and report are a reasonable and good faith effort to identify historic properties. The survey identified five resources 50 years of age or older within the area of potential effect (APE). Two resources were previously recorded and three were newly identified. One previously recorded resource, the Yatton House ((DHR ID #053-1071) was determined as to be potentially eligible for the National Register of Historic Places (NRHP) in 1993. The second previously recorded resource was found to be demolished at the time of this Phase I survey. Of the three newly identified resources, none were recommended as eligible for the NRHP, and were not found to contribute to the nearby Round Hill Historic District.
A cultural resources survey was conducted on the project site and a report prepared entitled “Phase I Archaeological Survey and Viewshed Analysis for the Skyhill Court Subdivision, Loudoun County, Virginia”, prepared by Bluestone Research 2004, LLC. The cultural resources survey identified one new archaeological site (44LD2149) within the project area. The site was determined to be a twentieth century (and possibly late nineteenth century) artifact scatter, is recommended as not eligible for inclusion on the NRHP, and no further work is recommended.
ADVERSE EFFECT DETERMINATION: In consultation with the State Historic Preservation Office, and in consideration of views concerning effects provided by consulting parties, the Corps applied the criteria of adverse effect to historic properties within the permit area. The Corps determined that the proposed federal action would result in an adverse effect on the Yatton House (053-1071). The Corps is consulting further to develop and evaluate alternatives or modifications to the undertaking that could avoid, minimize, or mitigate adverse effects on historic properties. The Corps, the Virginia Department of Historic Resources, the permittee, and other consulting parties are proposing to enter into a Memorandum of Agreement (MOA) under Section 106 of the NHPA.
