The District Commander has received a joint application for Federal and State permits as described below:

Loudoun Kline LLC 

WATERWAY AND LOCATION OF THE PROPOSED WORK: The project is located on two parcels totaling 2.49 acres (PINs 085169953 and 085171139) at 20708 Ashburn Road in Loudoun County, Virginia. The work will occur in a tributary to Beaverdam Run. 

PROPOSED WORK AND PURPOSE: The applicant is proposing to develop a 45 unit residential subdivision and associated infrastructure. The northwestern portion of the property is used as a storage yard for a landscaping company, with the remainder of the property maintained lawn. Approximately 0.04 acre of Waters of the United States consisting of 0.03 acre of palustrine emergent wetland and 0.01 acre (172 linear feet) of stream channel will be impacted by the proposed work.  

 PURPOSE OF PUBLIC NOTICE: The Corps’ permit action associated with this project is subject to Section 106 of the National Historic Preservation Act (NHPA).   Procedures have been established which must be followed in order for the Corps to comply with the NHPA and other applicable historic preservation laws.  The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Native American Tribes; and other interested parties in compliance with Section 106 of the National Historic Preservation Act (NHPA).  This public notice provides an opportunity for members of the public to express their views on the undertaking’s effects on historic properties and resolution of adverse effects.  Comments are requested to assist in evaluation of the effects of the project on historic properties and evaluation of alternatives or modifications which could avoid, minimize or mitigate adverse effects on historic properties. 

Historic Property Identification:   The identification of historic properties has been conducted on the proposed development site.  The proposed project lies within the Ashburn Historic District (053-0013) which is Eligible to the NRHP and is VLR-listed. There are also two (053-0013, 053-0276) recorded architectural resources recorded within the project bounds. Both properties are no longer extant.  There are no archaeological resources previously recorded in the project area.  

ADVERSE EFFECT DETERMINATION:  In consultation with the SHPO, the USACE has applied the criteria of adverse effect to historic properties within the APE.  An adverse effect on the Ashburn Historic District has been found for the project.  The USACE is consulting further to develop and evaluate alternatives or modifications to the undertaking that could avoid, minimize, or mitigate adverse effects on historic properties.  The US Army Corps of Engineers (Norfolk District), Virginia Department of Historic Resources and the permittee are proposing to enter into a Memorandum of Agreement (MOA) under Section 106 of the National Historic Preservation Act.   

COMMENT PERIOD:  Comments on this project should be in writing and can be sent by either email to, or by regular mail, addressed to the Norfolk District, Corps of Engineers, Northern Virginia Field Office, 18139 Triangle Plaza, Suite 213, Dumfries, VA 22026, and should be received by the close of business on November 24, 2017.
