Interested parties are hereby notified that a request for permission to alter a U.S. Army Corps of Engineers (USACE) federal project pursuant to Section 14 of the Rivers and Harbors Act of 1899, 33 U.S.C. 408 (Section 408) has been received and is under evaluation by the Norfolk District. This Section 408 request was submitted by 11th Street LC to repair and replace portions of the Virginia Beach Fishing Pier that sustained damage during Hurricane Erin. This project may alter the Virginia Beach Erosion Control and Hurricane Protection Project (VBHPP). Comments should be received by the close of business on March 30, 2026.

This Public Notice announces Norfolk District’s Final Regional Conditions, the Section 401 Water Quality Certification (WQC) and the Coastal Zone Management Act (CZMA) determination for the 57 nationwide permits (NWPs) that were published in the January 8, 2026, Federal Register (91 FR 768). The applicant has revised their plans based on the comments received during the 2019 public comment period. The Sponsor, The Barn Property, LLC, is now proposing 3,862 linear feet (LF) of stream channel restoration and 2,241 LF of stream enhancement. All streams would be protected on both sides by 100-foot (FT) buffers, including 3,052 credits associated stream buffer restoration/establishment.
