National Wetland Plant List (NWPL) - May 18, 2012: The National Wetland Plant List (NWPL) will become effective on June 1, 2012 and will be used in any wetland delineation performed after this date. Delineations received prior to this date may still use the 1988 list, or the 2012 list may be chosen. Prior to the effective date, please reference which list was used on any wetland delineation/determination forms. Excel & pdf versions of the NWPL by Region (Region boundaries are the same for the Regional Supplements & the NWPL) and State are now available for download from the NWPL.
NAO-2003-1984 - May 15, 2012: PER Properties has proposed to construct a grain terminal on the Southern Branch of the Elizabeth River in Portsmouth, Virginia. The facility will be located at 3991 Elm Avenue, formerly referred to as the “Allied Site”. This facility will store and ship about 5 million bushels of grain annually.
NAO-2012-0938 - May 10, 2012: The Nature Conservancy proposes to establish, design, construct, and monitor an In-lieu Fee (ILF) mitigation site on approximately 161 acres of private land to be purchased by the Nature Conservancy. The site is located adjacent to the 776-acre Pinnacle Natural Area Preserve in Russell County, Virginia. The goal of this mitigation site is to provide appropriate mitigation for unavoidable permitted impacts, within the authorized service area (Tennessee River Basin), by performing stream and riparian buffer enhancement and preservation. This mitigation site is being established pursuant Section 10 of the Rivers and Harbors Act and/or Section 404 of the Clean Water Act.

NAO-2012-0941 - May 10, 2012: The Nature Conservancy proposes to establish, design, construct, and monitor an In-lieu Fee (ILF) mitigation site approximately 10 acres of private land to be purchased by the Conservancy (or partners). The site is located within the boundary of the 5,200-acre Chickahominy Wildlife Management Area managed by the Virginia Department of Game and Inland Fisheries (VDGIF) in Charles City County, Virginia. The goal of the mitigation site is to provide appropriate mitigation for impacts, within the authorized service area (Lower James River Basin), by providing wetland, stream and riparian buffer preservation. This mitigation site is being established pursuant Section 10 of the Rivers and Harbors Act and/or Section 404 of the Clean Water Act.

NAO-2012-0950 - May 10, 2012: The Nature Conservancy proposes to establish, design, construct, and monitor an In-lieu Fee (ILF) mitigation site on approximately 53 acres of private land to be placed under deed restriction by the Nature Conservancy. The site is located along Cobb Mill Creek near Oyster Harbor in Northampton County, Virginia. The goal of the mitigation site is to provide appropriate mitigation for impacts, within the authorized service area (Atlantic Ocean Basin), by providing wetland, stream and riparian buffer preservation. This mitigation site is being established pursuant Section 10 of the Rivers and Harbors Act and/or Section 404 of the Clean Water Act.

NAO-2012-0937 - May 8, 2012: The Nature Conservancy proposes to establish, design, construct, and monitor an In-lieu Fee (ILF) mitigation site approximately 197 acres of private land and will be placed under easement with the Nature Conservancy. The site is located adjacent to the 1,853 acres protected as part of the Church Neck Conservation Corridor in Northampton County, Virginia. The goal of this mitigation site is to provide appropriate mitigation for unavoidable permitted impacts, within the authorized service area (Chesapeake Bay Basin), by performing wetland and wetland buffer preservation. This mitigation site is being established pursuant Section 10 of the Rivers and Harbors Act and/or Section 404 of the Clean Water Act.

NAO-2004-3638 - May 7, 2012: Boxley Material Company proposes to expand an existing overburden site in Martinsville (previously permitted in 2004; USACE and DEQ permits expired) which will be used for the relocation and construction of the operations plant and office facilities. Impacts will be to 1.29 acres of palustrine forested wetlands and 0.15 acres of palustrine emergent wetlands for a total of 1.44 acres. Mitigation will be accomplished via the purchase of compensation credits through an approved bank.

NAO-2012-0666 - May 4, 2012: The applicant proposes to widen existing Telegraph Road in Fairfax County to four lanes, from South Van Dorn Street (Rt. 613) to South Kings Highway (Route 633). The roadway typical section will include shoulders, 11-foot-wide lanes, and curb and gutter. A shared use path is proposed for the north side of Telegraph Road and a sidewalk is proposed for the south side. A three-chamber, three-sided bottomless culvert will be constructed to replace the twin corrugated metal pipes in Dogue Creek. Water and sewer lines will be relocated. The applicant states that widening of Telegraph Road is essential to handle increased traffic volumes at Ft. Belvoir following the implementation of the Base Realignment and Closure (BRAC).

NAO-2011-1384 - May 4, 2012: This project involves the widening of Route 50 in Fairfax County, between Routes 742 and 661. Stream and wetland impacts were previously authorized on November 16, 2011 under a Letter of Permission (LOP) 1, and this VDOT project is under construction. Due to design revisions and utility relocations, the applicant is proposing additional impacts at Cub Run which will exceed the limits allowable under the LOP-1. The following additional impacts at Cub Run are subject to this public notice: 75 square feet of permanent palustrine forested (PFO) wetland impacts; 1,777 square feet of permanent palustrine emergent (PEM) wetland impacts; 5,674 square feet of conversion of PFO to PEM wetlands; and 355 linear feet of temporary stream impacts. The new proposed total impacts at this crossing will now be 1,354 linear feet of stream impacts and 107,712 square feet (2.47 acres) of wetland impacts.

CENAP-OP-R-2011-1111-24 - April 27, 2012: Brasil Telcom of America proposes to replace a submarine telecommunications cable from Ocean County, New Jersey to Bermuda. The Regulatory Branch, Philadelphia District, will manage the Army Corps permit application. The Norfolk district is providing public notice of this permit application as a portion of the cable could be within 200 miles of Virginia, on the outer continental shelf. NAO-2011-1806 - April 25, 2012: The project consists of the discharge of fill material into waters of the United States associated with the development of an additional aircraft hangar and associated infrastructure. The project is called United Airlines Maintenance Hangar. The project is located on an approximately 15-acre parcel southwest of the intersection of Autopilot Drive and Materials Road at Washington Dulles International Airport in Loudoun County, Virginia. The work will occur in tributaries to Horsepen Run. Approximately 1.9 acres palustrine emergent wetlands will be impacted by the proposed project. The work includes grading associated with the construction of an aircraft hangar, aircraft apron, stormwater management facilities, underground utilities and taxiway improvements. Compensatory mitigation will be provided.

Federal Public Notice - April 23, 2012: Section 401 certification and Coastal Zone Management Act (CZMA) consistency determination for 2012 Nationwide Permits. As of April 23, 2012, the Norfolk District Corps of Engineers has received both the Clean Water Act Section 401 water quality certification and the CZMA consistency determination from the Virginia Department of Environmental Quality for the 2012 Nationwide Permits.
NAO-2011-2439 - April 16, 2012: Mr. Roger Jefferson proposes to place fill material in waters of the U.S. to construct a permanent irrigation source to irrigate the crops necessary to support his dairy operation. The project includes the construction of an instream impoundment using an earthen dam, with a standpipe and an emergency spillway to impound approximately 27,600,000 gallons of surface water. Comments on this project should be made in writing and should be received by the close of business on May 17, 2012.

NAO-2008-2691 - March 30, 2012: The applicant proposes to mechanically dredge approximately 65,000 cubic yards (CY) of subaqueous bottom material from designated Areas B, C, D, and E around the L-head of Pier CAD-A at the Naval Weapons Station Yorktown, Cheatham Annex (CAX) in York County, Virginia. Continued maintenance dredging is necessary to maintain adequate water depths the berthing areas at Pier CAD-A. The applicant has requested to conduct three (3) to four (4) maintenance dredging cycles over the next ten (10) years. Each dredging cycle is anticipated to remove 65,000 CY or less of dredged material, with a 3-4 month construction period. The dredged material will be placed on barges and transported for placement at the Norfolk Ocean Disposal Site (NODS) in the Atlantic Ocean, approximately 17 miles east of Cape Henry.
NAO-2008-01751 - March 29, 2012: The Fairfax County Department of Transportation is proposing the widening of Lorton Road from Silverbrook Road to Ox Road (Route 123), including Furnace Road from its intersection with Ox Road to Lorton Road, in Fairfax County, Virginia. The project site contains Giles Run and unnamed tributaries to Giles Run and consists of the widening of 2.8 miles of road, associated utility installations and infrastructure improvements. The proposed project would permanently impact approximately 0.92 acres of palustrine forested wetlands, and 2,927 linear feet of stream channel (2,313 linear feet of permanent impacts and 614 linear feet of temporary impacts). The proposed impacts will be mitigated offsite through the purchase of 5,304 stream credits from the Northern Virginia Stream Restoration Bank and 1.84 mitigation credits from the Loudon County Wetlands and Streams Restoration Bank.

NAO-2010-0543 - March 26, 2012: The In-Lieu Fee (ILF) sponsor proposes to establish an ILF that will provide off-site compensatory mitigation for projects that result in unavoidable impacts to nontidal wetlands and streams within the specified service area. The ILF sponsor proposes to identify streams or wetlands in southwest Virginia suitable for and capable of providing compensatory mitigation through the enhancement, restoration, creation, and preservation of wetlands and stream channels and their associated buffers. Wetland Hydrology Determinations for the 2012 Monitoring Season - March 22, 2012: The Norfolk District believes it beneficial to the public to provide seasonal Public Notices (PNs) regarding preceding precipitation conditions for shallow groundwater well monitoring associated with wetland determinations. The purpose of this PN is to inform the public of relevant parts of our process, and our interpretation and findings regarding current precipitation conditions for the 2012 monitoring season. This is accomplished by our analysis of several rainfall recording stations and our use of hydrology monitoring wells spaced across the Hampton Roads region.

Federal Public Notice - March 21, 2012: American Infrastructure-Virginia, Inc. proposes to construct a 1.2 mile extension of Middle Ground Boulevard between Jefferson Avenue (Route 143) and Warwick Boulevard (Route 60) in Newport News, VA, including sidewalks, a 10-foot wide shared use path, and an overpass over an existing railroad. Associated with the project are direct impacts to approximately 1.62 acres of nontidal forested wetlands. The purpose of the project is to address traffic congestion on several surrounding roadways and to provide for an east/west transportation connector between Jefferson Ave. and Warwick Blvd. For unavoidable impacts to forested wetlands, the applicant proposes to purchase credits at a 2:1 ratio (3.24 acres) from an approved mitigation bank that serves the project site.
Federal Public Notice - March 16, 2012: Effective immediately, and until further notice, the attached Regional Conditions are applicable within the Commonwealth of Virginia for the 2012 Nationwide Permits (NWPs), which were printed in the Federal Register on February 21, 2012 and will become effective on March 19, 2012. The Regional Conditions specify additional restrictions and requirements that have been placed on the applicable Nationwide Permits to ensure that impacts within the Commonwealth of Virginia will not be more than minimal.

Dismal Swamp Canal Atlantic Intracoastal Waterway Re-Opening to Navigation - March 14, 2012: Effective at 8:30 AM on March 19, 2012 the locks at Deep Creek, Virginia and South Mills, North Carolina will return to their normal operating schedule to accommodate vessels desiring to use the Dismal Swamp Canal (Route 2) of the Atlantic Intracoastal Waterway.
NAO-2012-00389 - March 12, 2012: The bank sponsor proposes to establish, design, construct, and operate a compensatory wetland and stream mitigation bank to be known as Fort AP Hill Offsite Mitigation Bank. The purpose of the mitigation bank is to provide off-site compensatory mitigation for projects associated with US Army Fort AP Hill that result in unavoidable impacts to streams, wetlands and other waters of the United States in the Mattaponi River Drainage basin. The goal of the bank is to provide improved water quality, habitat functions within the wildlife management area, Mattaponi River. In addition, to establish a self-sustaining, functional aquatic system to replace the functional values of streams and wetlands anticipated to be adversely affected for the authorized service area.

NAO-2010-1073 - March 9, 2012: The Linden 55 Plaza project consists of the discharge of fill material into waters of the United States associated with the commercial development of the subject tract. The project is located on an approximately 28.18-acre parcel east of the intersection of Apple Mountain Road (Route 79) and John Marshall Highway (Route 55) in Warren County, Virginia. The work will occur in Manassas Run and its tributaries. Approximately 1.31 acres palustrine forested wetlands (PFO), 0.55 acre palustrine emergent wetlands (PEM) and 959 linear feet of stream beds will be impacted by the proposed project. The work includes grading associated with the construction of lots, access roadways and utility and road improvements. An additional 60 linear feet of stream beds and 0.004 acre PFO will be temporarily impacted for installation of a water main. Compensatory mitigation will be provided.

NAO-2008-02410 - March 9, 2012: This same project was previously Public Noticed on 15 November 2011; however, the wetland impacts were underestimated. This revised Public Notice has the correct wetland impacts. The Chesapeake Regional Airport in Chesapeake, VA, proposes to expand the north terminal area by constructing new hangars, a new airport restaurant, a new aircraft wash rack, a new connector taxiway, a new airport access road, and relocating the airport security fence. The applicant claims the project will impact no more than 19.8 acres of forested wetlands, some of which have recently been clear-cut. The applicant proposes to compensate for these wetland impacts by purchasing credits from an approved wetland mitigation bank.

NAO-2011-00210 - February 24, 2012: Curtis Contracting, c/o Mr. Stephen Ordung, proposes to construct a 7.6-mile passive-use recreation trail parallel to and on the north side of Route 5, in Charles City County, from 0.25 miles west of the Chickahominy River Bridge to the intersection of Route 5 and Route 614 (Sturgeon Point Road). The trail will be eight feet wide, and primarily within VDOT right-of-way. The project will permanently impact a total of 1.25 acres of wetlands, including 0.19 acres of forested, 0.52 acres of scrub/shrub, and 0.54 acres of emergent wetlands. The project will temporarily impact 0.12 acres of wetlands. The purpose of the project is to provide low-impact passive-use recreational opportunity along Route 5, and ultimately, a connecting trail from James City County to Richmond. The wetland impacts will be mitigated by purchase of 1.7 acres of mitigation bank credits from Weatherbury Mitigation Bank.

NAO-2006-01180 - February 15, 2012: Pearce Dean, LLC proposes to establish, design, construct, and operate a compensatory tidal wetland mitigation bank to be known as Wythe Creek Salt Marsh Tidal Mitigation Bank. The proposed mitigation bank site is located on approximately 3.51 acres of pasture, forested fringe, and tidal wetlands. The site is located at 106 Collins Lane approximately 1,500 feet west of the intersection of Carys Chapel Road and Wythe Creek Road in York County, Virginia. The proposed bank site drains to an un-named tributary to Brick Kiln Creek, a tributary to the Northwest Branch of Back River.

NAO-2009-0529 - February 1, 2012: This shoreline stabilization is located at 16901 Sandy Point Road, in Charles City County on the James River. The purpose of the project is to stabilize approximately 5,300 linear feet of shoreline through the construction of offshore rock sills and breakwaters, with beach nourishment and planting of native wetland vegetation. The sills range in length from 40 to 250 feet and the breakwaters will range in length from 70 to 100 feet. The overall length of the combined structures will be 3,430 linear feet. These structures will cover approximately 16,723 square feet of subaqueous bottom, approximately 51,755 square feet of fill will be placed channelward of Mean Low Water, and approximately 55,173 square feet of non-vegetated intertidal area will be filled for shoreline stabilization. A proposed 5-foot wide by 16-foot long open-pile pedestrian bridge will be constructed over a tidal creek. To provide boat access, a 12-foot wide by 38-foot long concrete boat will be constructed in the James River.
NAO-2008-1100 - February 1, 2012: The Norfolk District has received an application from Henry County for the proposed Commonwealth Crossing Business Centre to provide pre-developed infrastructure, transportation and pad site improvements of a size necessary to attract an industrial user capable of providing a transformational, substantial positive economic impact to the Martinsville/Henry County area. The project is located in Henry County, Virginia and Rockingham County, North Carolina along Paterson Branch, a tributary to Marrowbone Creek and the Roanoke River. The entire parcel known as the Roma-Sharpe property is 739 acres; for the proposed phase one, 249 acres will be developed. Stream impacts are proposed to be 12,301 linear feet. Wetland impacts will be 0.67 acres. Compensation and mitigation are proposed as follows: 5,395 linear feet of stream (including Patterson Branch on the Sharpe Property) will be preserved onsite for a total of 1,201 compensation credits and 0.89 acres of wetlands; approximately 6,500 additional credits will be purchased from stream mitigation banks and 0.97 wetlands credits will be purchased from a wetland mitigation bank. Offsite compensation on the Bryant Tract is proposed as 12,126 linear feet of stream and 7 acres of wetlands. Comments should be received by close of business March 1, 2012. A Public Notice will be run concurrently by the Wilmington District ACOE for impacts in North Carolina.

NAO-2010-01201 - January 31, 2012: The bank sponsor, Mr. Ashlby, proposes to establish, design, construct, and operate a compensatory stream mitigation bank to be known as Swift Creek Umbrella Mitigation Bank at Moseley. The purpose of the mitigation bank is to provide off-site compensatory mitigation for projects that result in unavoidable impacts to streams in portions of the James River drainage basin. The goal of the bank is to restore enhance, and preserve in perpetuity approximately 298 acres of land, containing waters of the U.S.

NAO-2011-2206 - January 26, 2012: The Corps has received a prospectus to establish a tidal wetland mitigation bank in Portsmouth, Virginia. The bank sponsor, Hull Creek Mitigation, LLC, proposes to establish, design, construct, and operate a compensatory wetland mitigation bank to be known as Hull Creek Mitigation Bank. The purpose of the mitigation bank is to provide off-site compensatory mitigation for projects that result in unavoidable impacts to tidal wetlands and other waters of the United States in the Hampton Roads / Elizabeth River Drainage basin. The Bank Sponsor plans to establish this Bank by restoring tidal wetlands on approximately 4 acres of historically filled tidal wetlands. Comments on this project should received by the close of business on February 27, 2012.

NAO-2008-00429 - January 16, 2012: Chesterfield County Economic Development proposes to permanently impact 0.99 acre of forested wetlands and to permanently convert 0.26 acre of forested wetlands to emergent wetlands to continue construction of a county thoroughfare from Meadowville Road to Enon Church Road and Bermuda Hundred Road within the Meadowville Technology Park. The proposed main road corridor and a shorter connector road total approximately 6,200 linear feet . Proposed wetland impacts are for the construction of a road crossing and associated erosion and sediment control measures and a waterline crossing.

NAO-2011-1734 - January 13, 2012: Norfolk Southern Railway Company proposes to construct additional rail capacity at Portlock Rail Yard, an existing railroad yard and transportation facility located in the South Norfolk area of Chesapeake, Virginia. The additional rail capacity will accommodate the addition of passenger rail service to existing main tracks that are currently used exclusively for freight rail traffic. The project will impact 0.88 acres of non-tidal forested wetlands and 5,150 linear feet of an existing ditch on the west side of the railroad tracks in the south portion of the project area where two existing storage tracks will be extended. The comment period expires February 13, 2012.

NAO-2011-00647 - January 10, 2012: The applicant, Arlington Dominion LLC, is proposing to construct a luxury apartment complex in Chesapeake, Virginia. The Plantation Greens project will include a 368-unit apartment complex, associated roadways, and infrastructure. The project requires the extension of Cahoon Parkway, which is part of the City’s Master Transportation Plan; and the project also includes and a 2-acre commercial outparcel (to be occupied by the Surf Rider Restaurant) at the intersection of Cahoon Parkway & Grassfield Parkway. This permit application represents the entire development, associated roadways and infrastructure. There are 9.43 acres of forested and scrub-shrub (PFO, PSS) wetlands and 0.27 acre of intermittent Waters of the U.S. (R4OW) on the site. The wetland impacts associated with the proposed project have been reduced to 4.12-acre of forested and scrub shrub wetlands and 0.06 acre of waters of the U.S. Compensatory mitigation will be accomplished through purchasing wetland credits (2:1 for PFO and 1.5:1 for PSS) from an approved mitigation bank in the subject watershed.
Web-based training in RIBITS, Norfolk's Interactive Web-Based Mitigation Band and In-Lieu Fee Tracking System - January 10, 2012: In February 2012, Norfolk District's Regulatory Office will hold two web-based training sessions for the public in the use of the Corps' national web-based mitigation bank and in-lieu fee program tracking system known as RIBITS (Regulatory In-lieu Fee and Bank Information Tracking System). The training sessions are scheduled for Tuesday, February 28 at 10AM (EST) and Tuesday, February 28 at 2PM (EST). Registration will be first-come, first served and must be received by February 1, 2012. NAO-2009-00523 Graham and David Mitigation Bank - January 5, 2012: This is an amended Public Notice to reflect receipt of the final prospectus for public comment and review. Comments already received under the original notice that ran from December 7, 2011 to January 5, 2012 will be considered as will any new comments. The bank sponsor proposes to establish, design, construct, and operate a compensatory stream mitigation bank to be known as Graham and David Mitigation Bank. It will consist of preservation of 5,891 linear feet (LF) of perennial streams, 47,288 LF of ephemeral streams, 2.3044 acres of wetlands, 288 acres of preservation and enhancement of proposed uplands buffers and 106 acres of watershed buffers, comprising nearly the entire watershed for the project location. In addition the proposed Bank site contains and proposes to preserve a unique travertine waterfall stream system and habitat for Federally threatened and endangered Roanoke Logperch (Percina rex) and several other state species of concern. The proposed credits are 0.44 wetlands credits and 43,537 stream credits.

NAO-2011-02495 - January 4, 2012: Mr. Steven Ash and Mr. Frederic McGhee propose to mechanically dredge 1200 cubic yards of sandy material from an existing 680 foot long by 25 foot wide channel to restore depths to minus six feet at mean low water. The applicants also propose to construct a 270 foot long by 22 foot wide stone jetty adjacent to the dredged channel, extending 226 feet channelward of mean high water. Finally, four low-profile timber groins are to be constructed extending a maximum of 48 feet channelward of mean high water and all material from the channel dredging will be placed as beach nourishment within the groin cells.
