<p>May 4, 2012: The applicant proposes to widen existing Telegraph Road in Fairfax County to four lanes, from South Van Dorn Street (Rt. 613) to South Kings Highway (Route 633).  The roadway typical section will include shoulders, 11-foot-wide lanes, and curb and gutter.  A shared use path is proposed for the north side of Telegraph Road and a sidewalk is proposed for the south side.  A three-chamber, three-sided bottomless culvert will be constructed to replace the twin corrugated metal pipes in Dogue Creek.  Water and sewer lines will be relocated.  The applicant states that widening of Telegraph Road is essential to handle increased traffic volumes at Ft. Belvoir following the implementation of the Base Realignment and Closure (BRAC).

<p>May 4, 2012: This project involves the widening of Route 50 in Fairfax County, between Routes 742 and 661. Stream and wetland impacts were previously authorized on November 16, 2011 under a Letter of Permission (LOP) 1, and this VDOT project is under construction. Due to design revisions and utility relocations, the applicant is proposing additional impacts at Cub Run which will exceed the limits allowable under the LOP-1. The following additional impacts at Cub Run are subject to this public notice: 75 square feet of permanent palustrine forested (PFO) wetland impacts; 1,777 square feet of permanent palustrine emergent (PEM) wetland impacts; 5,674 square feet of conversion of PFO to PEM wetlands; and 355 linear feet of temporary stream impacts. The new proposed total impacts at this crossing will now be 1,354 linear feet of stream impacts and 107,712 square feet (2.47 acres) of wetland impacts.

<p>March 30, 2012: The applicant proposes to mechanically dredge approximately 65,000 cubic yards (CY) of subaqueous bottom material from designated Areas B, C, D, and E around the L-head of Pier CAD-A at the Naval Weapons Station Yorktown, Cheatham Annex (CAX) in York County, Virginia.  Continued maintenance dredging is necessary to maintain adequate water depths the berthing areas at Pier CAD-A.  The applicant has requested to conduct three (3) to four (4) maintenance dredging cycles over the next ten (10) years.  Each dredging cycle is anticipated to remove 65,000 CY or less of dredged material, with a 3-4 month construction period.  The dredged material will be placed on barges and transported for placement at the Norfolk Ocean Disposal Site (NODS) in the Atlantic Ocean, approximately 17 miles east of Cape Henry.

The project site contains Giles Run and unnamed tributaries to Giles Run and consists of the widening of 2.8 miles of road, associated utility installations and infrastructure improvements.  The proposed project would permanently impact approximately 0.92 acres of palustrine forested wetlands, and 2,927 linear feet of stream channel (2,313 linear feet of permanent impacts and 614 linear feet of temporary impacts).  The proposed impacts will be mitigated offsite through the purchase of 5,304 stream credits from the Northern Virginia Stream Restoration Bank and 1.84 mitigation credits from the Loudon County Wetlands and Streams Restoration Bank.

<p>March 22, 2012: The Norfolk District believes it beneficial to the public to provide seasonal Public Notices (PNs) regarding preceding precipitation conditions for shallow groundwater well monitoring associated with wetland determinations.  The purpose of this PN is to inform the public of relevant parts of our process, and our interpretation and findings regarding current precipitation conditions for the 2012 monitoring season.  This is accomplished by our analysis of several rainfall recording stations and our use of hydrology monitoring wells spaced across the Hampton Roads region.

Associated with the project are direct impacts to approximately 1.62 acres of nontidal forested wetlands. <p>March 9, 2012: The Linden 55 Plaza project consists of the discharge of fill material into waters of the United States associated with the commercial development of the subject tract.  The project is located on an approximately 28.18-acre parcel east of the intersection of Apple Mountain Road (Route 79) and John Marshall Highway (Route 55) in Warren County, Virginia.  The work will occur in Manassas Run and its tributaries.  Approximately 1.31 acres palustrine forested wetlands (PFO), 0.55 acre palustrine emergent wetlands (PEM) and 959 linear feet of stream beds will be impacted by the proposed project. The work includes grading associated with the construction of lots, access roadways and utility and road improvements.  An additional 60 linear feet of stream beds and 0.004 acre PFO will be temporarily impacted for installation of a water main.  Compensatory mitigation will be provided.

The Chesapeake Regional Airport in Chesapeake, VA, proposes to expand the north terminal area by constructing new hangars, a new airport restaurant, a new aircraft wash rack, a new connector taxiway, a new airport access road, and relocating the airport security fence. The applicant claims the project will impact no more than 19.8 acres of forested wetlands, some of which have recently been clear-cut. The applicant proposes to compensate for these wetland impacts by purchasing credits from an approved wetland mitigation bank.

<p>February 24, 2012: Curtis Contracting, c/o Mr. Stephen Ordung, proposes to construct a 7.6-mile passive-use recreation trail parallel to and on the north side of Route 5, in Charles City County, from 0.25 miles west of the Chickahominy River Bridge to the intersection of Route 5 and Route 614 (Sturgeon Point Road).  The trail will be eight feet wide, and primarily within VDOT right-of-way.  The project will permanently impact a total of 1.25 acres of wetlands, including 0.19 acres of forested, 0.52 acres of scrub/shrub, and 0.54 acres of emergent wetlands.  The project will temporarily impact 0.12 acres of wetlands.  The purpose of the project is to provide low-impact passive-use recreational opportunity along Route 5, and ultimately, a connecting trail from James City County to Richmond.  The wetland impacts will be mitigated by purchase of 1.7 acres of mitigation bank credits from Weatherbury Mitigation Bank.

February 1, 2012: This shoreline stabilization is located at 16901 Sandy Point Road, in Charles City County on the James River. The purpose of the project is to stabilize approximately 5,300 linear feet of shoreline through the construction of offshore rock sills and breakwaters, with beach nourishment and planting of native wetland vegetation. The sills range in length from 40 to 250 feet and the breakwaters will range in length from 70 to 100 feet. The overall length of the combined structures will be 3,430 linear feet. These structures will cover approximately 16,723 square feet of subaqueous bottom, approximately 51,755 square feet of fill will be placed channelward of Mean Low Water, and approximately 55,173 square feet of non-vegetated intertidal area will be filled for shoreline stabilization. A proposed 5-foot wide by 16-foot long open-pile pedestrian bridge will be constructed over a tidal creek. To provide boat access, a 12-foot wide by 38-foot long concrete boat will be constructed in the James River.

<p>February 1, 2012: The Norfolk District has received an application from Henry County for the proposed Commonwealth Crossing Business Centre to provide pre-developed infrastructure, transportation and pad site improvements of a size necessary to attract an industrial user capable of providing a transformational, substantial positive economic impact to the Martinsville/Henry County area. The project is located in Henry County, Virginia and Rockingham County, North Carolina along Paterson Branch, a tributary to Marrowbone Creek and the Roanoke River.  The entire parcel known as the Roma-Sharpe property is 739 acres; for the proposed phase one, 249 acres will be developed.  Stream impacts are proposed to be 12,301 linear feet.  Wetland impacts will be 0.67 acres. Compensation and mitigation are proposed as follows: 5,395 linear feet of stream (including Patterson Branch on the Sharpe Property) will be preserved onsite for a total of 1,201 compensation credits and 0.89 acres of wetlands; approximately 6,500 additional credits will be purchased from stream mitigation banks and 0.97 wetlands credits will be purchased from a wetland mitigation bank.  Offsite compensation on the Bryant Tract is proposed as 12,126 linear feet of stream and 7 acres of wetlands. Comments should be received by close of business March 1, 2012. A Public Notice will be run concurrently by the Wilmington District ACOE for impacts in North Carolina.

The project requires the extension of Cahoon Parkway, which is part of the City’s Master Transportation Plan; and the project also includes and a 2-acre commercial outparcel (to be occupied by the Surf Rider Restaurant) at the intersection of Cahoon Parkway & Grassfield Parkway. This permit application represents the entire development, associated roadways and infrastructure. There are 9.43 acres of forested and scrub-shrub (PFO, PSS) wetlands and 0.27 acre of intermittent Waters of the U.S. (R4OW) on the site. The wetland impacts associated with the proposed project have been reduced to 4.12-acre of forested and scrub shrub wetlands and 0.06 acre of waters of the U.S. Compensatory mitigation will be accomplished through purchasing wetland credits (2:1 for PFO and 1.5:1 for PSS) from an approved mitigation bank in the subject watershed.

The bank sponsor proposes to establish, design, construct, and operate a compensatory stream mitigation bank to be known as Graham and David Mitigation Bank.  It will consist of preservation of 5,891 linear feet (LF) of perennial streams, 47,288 LF of ephemeral streams, 2.3044 acres of wetlands, 288 acres of preservation and enhancement of proposed uplands buffers and 106 acres of watershed buffers, comprising nearly the entire watershed for the project location. <p>December 21, 2011: On Wednesday, January 4, 2012, the Corps of Engineers will begin repairs to the South
Mills Lock on the Dismal Swamp Canal. Therefore, the locks at Deep Creek, Virginia and South
Mills, North Carolina will stop operating after the last scheduled locking at 3:30 PM on Tuesday,
January 3, 2012. The Dismal Swamp Canal, Route 2 of the Atlantic Intracoastal Waterway, will
be temporarily closed to through vessel traffic until repairs are complete. The repairs are
expected to take 60 to 90 days.

The Albemarle and Chesapeake Canal, Route 1 through the Great Bridge lock at
Chesapeake, Virginia, will be open 24 hours per day, seven days per week. Operators will

Total interidal/subtidal area impacts for both the proposed breakwaters and the beach replenishment will be approximately 6.2 acres. The rock and/or sand used in the construction will be either barged in or trucked in over state roadbeds. The stated purpose for the proposal is to stabilize this severely eroded shoreline to benefit 21 shoreline properties; and, to create habitat for the Northeastern Beach Tiger Beetle (Cincindela dorsalis dorsalis), species listed as Threatened on the Endangered Species List and whose life cycle depends on open bay beaches. There are no submerged aquatic beds and/or wetland vegetation to be adversely effected by the proposed construction activities.

The goal of this mitigation site is to provide appropriate mitigation for unavoidable permitted impacts, within the authorized service area (Chowan River Basin), by performing stream and riparian buffer restoration. The ILF Sponsor plans to establish this site by restoring 4,200 linear feet of two headwater tributaries and preservation of a 100-foot forested buffer along the tributaries on approximately 20 acres.  In addition, to providing mitigation, the restoration activities will also provide enhanced and protected habitat for several natural heritage species including the Red-cockaded Woodpecker. This mitigation site is being established pursuant Section 10 of the Rivers and Harbors Act and/or Section 404 of the Clean Water Act.

The channel was originally dredged to a design width of 30 feet and to a depth of -4.0 feet mean low water (MLW) with a -1.0 foot overdepth allowance.  The new work dredging will occur along Stations 226+05 to 263+10.  The new work dredging includes the removal of approximately 15,000 CY of material and the widening of the channel from 30 feet to 40 feet and deepening of the channel from -5.0 feet MLW (with max. overdredge depth) to -6.0 feet (with max. overdredge depth).</p>

Reedy Creek Mitigation, LLC, proposes to establish Reedy Creek Mitigation Bank to provide compensation for unavoidable impacts to waters of the United States and state waters in the Nottoway River watershed, part of the Chowan River drainage basin. The purpose of the Bank will be to provide offsite compensation for the unavoidable loss of streams and wetlands as a result of aquatic impacts from development projects authorized under Section 401 and 404 of the Clean Water Act, Section 10 of the Rivers and Harbor Act, and Section 62.1-44.15:20-23 of the Code of Virginia provided such impacts have met all applicable requirements and are approved by the respective permitting agencies.

            <p>September 07, 2011: Elizabeth River Crossings, LLC is proposing the construction of a new, two-lane Midtown Tunnel which will run on a curvilinear alignment to the northwest of the existing Midtown tunnel in the Elizabeth River, in Norfolk and Portsmouth, Virginia. The proposed new tunnel will provide for east-west travel, connecting U.S. Route 58 and the Western Freeway in Portsmouth to Brambleton Avenue/Hampton Boulevard in Norfolk. The tunnel project will include two temporary marshalling piers on the Portsmouth side, a temporary floating pier, three temporary 37-pile dolphins, 18,165 square feet of permanent shallow water fill to house the new tunnel support building, and a 320-foot long permanent steel pile bulkhead which will protect the new tunnel. The tunnel installation will require dredging approximately 1,500,000 cubic yards of material. Dredged material placement options include ocean placement at the Norfolk Ocean Disposal Site (NODS) and upland disposal at a regional landfill. This project will impact approximately 1,176 square feet of non-tidal vegetated wetlands, 7,361 square feet of tidal vegetated wetlands, 15,848 square feet of non-vegetated tidal wetlands (primarily rip rap), and approximately 25 acres (1,097,612 sq. ft.) of Elizabeth River bottom, of which seven acres is located within the recently dredged Federal Navigation Channel.

To mitigate for the proposed impacts, the applicant proposes to purchase  8.66 credits from the Coverly Wetlands  Mitigation Bank.  The applicant indicated that wetland impacts have been minimized by clustering the proposed development in the western portion of the site.  The applicant is also proposing to implement Low Impact Development techniques and to establish and maintain a 25 foot vegetated buffer around the wetlands not proposed for impacts.<br>

October 19, 2010: The Virginia Department of Transportation proposes to repair pipe crossings at nine different locations by installing steel rebar and mesh inside the pipes, then covering with shotcrete (a form of concrete) up to 4 inches thick. At each location, the resulting pipe invert (bottom) elevations would be raised at least four inches. The invert elevations of the existing pipes range from 0" to 15" above the stream bottom, and present some degree of obstruction to the movement of aquatic organisms. The Norfolk District’s Regional Permit 37 (05-RP-37) is scheduled to expire on November 21, 2010.  This permit currently authorizes certain Natural Resource Conservation Service (NRCS) performed or funded activities under the Emergency Watershed Protection Program that occur in waters of the United States, including wetlands, that have minimal environmental impacts.

Through recent coordination with NRCS, the Norfolk District has determined the RP-37 is no longer needed and will not be reissuing this permit because it covers the same activities as the Nationwide Permit 37.  However, when the RP-37 was issued in 2005, it suspended the Nationwide Permit 37.

Therefore, on this date, the Nationwide Permit 37 is hereby reinstated for use in the Commonwealth of Virginia and the Regional Permit 37 will expire on November 21, 2010.

Previously, the U.S. Army Corps of Engineers (the Corps) and the Virginia Department of Environmental Quality (VDEQ) indicated the estimated amount due as an in lieu fee contribution to compensate for particular impacts permitted under the Clean Water Act by the Corps and/or by VDEQ. Such estimates previously provided by the Corps and/or VDEQ will be honored if paid by June 8, 2010. TNC will assume responsibility to determine wetland and stream mitigation credit costs and the availability of credits.             <p>January 11, 2010: The U.S. Fish and Wildlife Service is proposing 
            a project which involves the stabilization of an eroding strip of 
            land (berm) and placement of low weirs across a canal and minor ditch 
            between Lake Tecumseh and Asheville Bridge Canal in the Sandbridge 
            area of Virginia Beach, Virginia. The project includes a boat portage 
            rollover mechanism, approved by local users, to allow boats to continue 
            to move between the lake and Asheville Bridge Canal. The project is 
            located in Lake Tecumseh a tributary to Ashville Bridge Creek and 
            Back Bay, north of Sandbridge Road in Virginia Beach, Virginia. Expiration

              proposes to establish, design, construct, and operate a compensatory 
              tidal and nontidal wetland mitigation bank to be known as Wallops 
              Tidal and Nontidal Wetland Mitigation Bank.The proposed mitigation 
              bank site is located on approximately 4,522 acres of federally owned 
              land. The site is located at Wallops Flight Facility in Accomack 
              County, Virginia. The proposed bank site drains to Hog Creek, Bogues 
              Bay, and Chincoteague Inlet, tributaries of the Atlantic Ocean.
